Dear "OSGeo - Public Geospatial Data" Committee,
Dear Mr. Zachariadis,

I contacted the EEA concerning my request to host the Greek CORINE land
cover dataset. I am forwarding you the reply from EEA. My questions
directed to EEA concerning the CORINE land cover dataset for Greece
where:

1. Are there any further restrictions besides the "Rights" [6] that are
clearly stated in the respective web-page[1]?

2. Does any legal issue arise from the use of wget to download
CORINE2000 tiles from the web-link mentioned in the references [3]?

3. Is it illegal to host the ready-to-use "greek" CORINE2000 map (ESRI
Shapefile) to an open-access server with other public domain geospatial
data?


The message I have sent to EEA is to be read in the forwarded message
and the reply from Mrs. Ana Sousa as well. As far as I understand there
are _no_ legal issues. However, allow me please to focus on 2 things:


i. Mrs. Ana Sousa wrote:

The European seamless Corine database is under copyright of the EEA and
within public domain. Public domain information may be used free of
charge, both for commercial or non-commercial purposes, provided the
source is acknowledged. The acknowledgement should read: "(c) EEA,
Copenhagen, 2007"

Comment:

The phrase "both for commercial or non-commercial purposes" is something
I read for the first time with respect to the CORINE land data base. If
I am not wrong, the "Rights" (=terms of use) [*] are talking clearly
about "not to use the data/applications for commercial purposes unless
the Agency has expressly granted the right to do so".

ii. The EEA does not encourage the proliferation of different download
facilities. Furthermore, she suggests to contact (greek) national
authorities and present them my tutorial about CORINE with GRASS (in the
Greek language).

Comment:

I will be very happy to receive a positive response from national
authorities. Nevertheless, the tutorial I have prepared is clearly
targeting GRASS-GIS users and the OSGeo community in general. From this
point of view, the dataset (along with its attribute tables) that is
ready-to-use is part of the tutorial (even if it is the end-product of
the tutorial). My personal desire is to host this dataset in OSGeo.

Regarding your request concerning potential legal issues arising from the use of the CORINE2000 dataset, and before replying directly to your questions, I would like to try to explain what is the situation regarding the dissemination of the European and the national Corine datasets:

EEA is "responsible" for the dissemination of the European Corine dataset (which we do by means for the CLC download facility found in the following web link - http://www.eea.europa.eu/themes/landuse/clc-download).
The national datasets should, in principle, be disseminated by the national authorities. Whenever a country is not able to provide a dissemination service for the national dataset, the public can use EEA download service and select the tiles that correspond to the country of interest.

The European seamless Corine database is under copyright of the EEA and within public domain. Public domain information may be used free of charge, both for commercial or non-commercial purposes, provided the source is acknowledged. The acknowledgement should read: "(c) EEA, Copenhagen, 2007"

In general we do not encourage the proliferation of different sites for download of data. In general we suggest that a reference is made to our download facility http://www.eea.europa.eu/themes/landuse/clc-download thus avoiding duplication of information in several places. We do not encourage it because, whenever a tile is changed because of some correction that was made to it, a new file will be produced. This way we risk ending up with different versions spreading around, which is not desirable. It is at its source that the information is better managed and kept and EEA cannot cope with keeping other download sites informed about changes.

Regarding your questions, and as far as EEA is concerned, we do not see any legal issues arising from your first and second questions. Regarding the third one, as previously explained, we do not encourage the proliferation of different download facilities.

Nevertheless, since you are only interested in the Greek dataset, I see the possibility that you do it in connection with the Greek authorities responsible for Corine production and dissemination. I strongly suggest that you contact the national authorities and show them your proposal. I believe that it may be of interest for the Greek authorities.

I put in copy the National Focal Point for the EEA (Mrs. Mata Aravantinou - [hidden email]) and the National Reference centre for spatial analysis and land cover, responsible for Corine production (Annie Katsina - [hidden email]).

I have a specific question concerning potential legal issues using the
CORINE2000 dataset.

I have prepared a tutorial (in the Greek language) upon how to use the
CORINE2000 tiles (as ESRI Shapefiles) [1] using GRASS-GIS [2].
Specifically the tutorial demonstrates how to build the CORINE2000 map
for Greece.

One of the most interesting parts of this tutorial is the demonstration
of the tool "wget" under Linux in order to easily obtain the CORINE2000
tiles of interest from a specific web-link [3].

In the tutorial I explicitly express that the data are:
- NOT for commercial use
- provided by the EEA (source acknowledged as: Copyright EEA, Copenhagen
2007) along with the link http://www.eea.europa.eu

However, before I proceed to publish the tutorial on a ("greek") blog
which is dedicated to issues about public domain information and data
[4], I want to be ensured that there will be no legal issues.

In addition I would like to provide the "greek" CORINE2000 map
(Shapefile, ~86MB tarzipped) on a server which host's public domain
geospatial data (e.g. [5]).


My questions are:

1. Are there any further restrictions besides the "Rights" [6] that are
clearly stated in the respective web-page[1]?
2. Does any legal issue arise from the use of wget to download
CORINE2000 tiles from the web-link mentioned in the references [3]?
