Hi, I need someones expertise. I recently had my CA-2 claim accepted  for "permanent aggravation of the herniated nucleus pulposus conditions of the cervical, thoracic and lumbar spine". I filed did not file as an aggravation but rather as work caused my injury. They accepted 7 diagnosis codes, for 4 herniated discs, plus related nerve pain and degenerative disc disease and changes. So my question is how did they turn this into an "permanent aggravation" and what does that mean to me? I have looked on DOL website and they list plenty of info under temporary aggravation but not much on permanent. How does this designation affect me? What if I can't return to my route, do they still have to provide vocational retraining, etc.? Any replies will be most appreciated. Do I need to appeal that work was the CAUSE of this? I am going to be scheduled for disc replacement or disc fusion on my neck now that the claim has been accepted, they will deal with the rest of the back after that.

I don't know too much about it, but I googled "permanent aggravation" and came up with a lot of links.  Maybe one or two of them might help  you out.  Good luck - that surgery sounds kind of scary.

Thanks, I looked at some of those but I am hoping some other carrier has had a similar condition and may have more info. I don't know what the H*** to do. Or how to understand what this really means!

I know what you mean about trying to understand it all.  Seems you have to be a lawyer AND a doctor to figure it out.  And even then it's probably a matter of how good an argument you can put up.
